Terms of service

These Terms of Service govern use of the QOR360 Australia online store and purchases made through it. The store is operated by NL-Tec Pty Ltd (ABN 72 066 375 166), trading online as QOR360 Australia. In these terms, “we”, “us” and “our” mean NL-Tec Pty Ltd.

By using the store or placing an order, you agree to these terms. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Using the store

You must use the store lawfully and must not interfere with its operation, security or other users. You must not introduce malicious code, attempt unauthorised access, scrape or reproduce store content unlawfully, use the store fraudulently, or infringe another person's rights.

You must provide current, complete and accurate information needed to process an order. If you use an account, you are responsible for keeping its credentials confidential and for activity conducted through it, except to the extent caused by our act or omission.

Products and information

We take reasonable care to describe and display products accurately. Colours and appearance can vary between screens, and minor product details may change. Images are illustrative unless stated otherwise.

Information on the store is general information only. Health-related information is subject to our Medical Disclaimer and is not personal medical advice.

Prices, GST and payment

Prices are stated in Australian dollars and include GST where applicable. Any available delivery charge will be shown before you submit the order; standard shipping within Australia is currently free.

You authorise us and our payment providers to charge the amount shown at checkout using your selected payment method. You must be authorised to use that payment method.

Orders

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean we have accepted the order. We may accept an order by sending an acceptance or fulfilment confirmation or by dispatching the product.

We may decline or cancel an order before acceptance where, for example, a product is unavailable, pricing or product information contains a genuine error, payment is not authorised, delivery is not available to the address, or fraud or misuse is reasonably suspected. If we cancel after taking payment, we will refund the amount paid.

Product availability is not guaranteed until an order is accepted. Purchase quantities may be limited where reasonably necessary.

Delivery

We deliver only within Australia. Delivery is governed by our Shipping Policy. Any delivery date is an estimate unless we expressly agree otherwise.

Cancellations, returns and refunds

Contact us promptly if you wish to cancel an order. We cannot guarantee cancellation after fulfilment has begun. Returns, the 60-day change-of-mind trial and remedies for product problems are governed by our Refund and Returns Policy and the Australian Consumer Law.

Consumer guarantees and warranty

Our products come with consumer guarantees under the Australian Consumer Law that cannot be excluded. Depending on the circumstances, you may be entitled to a repair, replacement, refund, compensation or other remedy.

Our voluntary three-year warranty is described in the QOR360 Australia 3-Year Warranty. It is additional to, and does not limit, your rights under the Australian Consumer Law.

Intellectual property

The store and its content, including text, graphics, photographs, product names, trade marks, logos and software, are owned by us, QOR360 or our licensors and are protected by applicable intellectual-property laws. You may use the store for personal, non-commercial shopping and information purposes. No other right or licence is granted except as expressly stated or permitted by law.

Third-party services and links

The store uses third-party services, including Shopify and payment and delivery providers. Links to third-party sites are provided for convenience. We are not responsible for third-party content, terms or privacy practices, except to the extent responsibility cannot lawfully be excluded.

Disclaimers and liability

To the maximum extent permitted by law, we do not guarantee that access to the store will always be uninterrupted, error-free or secure. We may suspend the store for maintenance, security or operational reasons.

Nothing in these terms excludes, restricts or modifies the Australian Consumer Law or any other guarantee, condition, warranty, right or remedy that cannot lawfully be excluded or modified.

Where liability may lawfully be limited, we are not liable for loss that was not reasonably foreseeable, was not caused by our breach, or was caused by your failure to take reasonable steps to avoid or reduce it. This provision does not limit liability where doing so would be unlawful.

Errors and changes

We may correct genuine errors or omissions in store information and update products, prices, these terms or other policies. A change to these terms applies from the effective date of the updated version and does not retrospectively alter an accepted order unless required by law or agreed with you.

Governing law

These terms are governed by the laws of Western Australia and the applicable laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and courts entitled to hear appeals from them. This does not prevent you from exercising rights in another jurisdiction where applicable law permits you to do so.
